- Website: Wine Concepts Online (herein referred to as WCOL), is owned by Wine Concepts® Newlands, Cape Town, South Africa and is operated from their offices and marketed and communicated using the Wine Concepts® website (www.wineconcepts.co.za).
By accessing and using the website, the user agrees to the Terms and Conditions set out in this document. - Intellectual Property: The user may not access, display, use, download, copy or distribute any content obtained on the website for marketing or for any other purpose without the prior written consent of Wine Concepts®.
- Purchaser Minimum Age: Purchasers must be over 18 years of age. Accordingly, you indemnify Wine Concepts® from any and all liability in this regard, including any liability arising as a result of your failure to provide accurate information in this regard when completing the website purchasing process.
- Prices: Wine Concepts® reserves the right to change “direct order” prices should changes occur in the prices that they pay their suppliers or wine farms. All wines are subject to availability. The prices displayed are inclusive of VAT at the applicable rate. Delivery costs are charged separately on check out and do not form part of the product price displayed.
- Payment: Payment will only be accepted by Credit Card / EFT via Payfast, or SnapScan, and receipt will be acknowledged once the payment is reflected in the Wine Concepts® bank account. Wine Concepts® has no access to your credit card details. PayFast may require further authentication on credit card payments, which they will request from you after you have submitted your payment. Any refunds will be done via EFT directly from Wine Concepts®.
- Bank Card Security and Personal Information Confidentiality: Wine Concepts® understand the importance of privacy and security. We are committed to protecting all the information we collect from our customers and guarantee that it will only be used for the purposes of fulfilling wine orders and related services, or communicating Wine Concepts® specials and newsletters.
- Communication: Upon ordering, customers:
- Will automatically receive the monthly Wine Concepts® Newsletter. A customer may unsubscribe from these communications at any time. (A minimum of one week should be allowed for purchasers address to be removed from the distribution list).
- Limitation of Liability: Wine Concepts® accept no liability for the accuracy of the content on their website. The users of the website do so entirely at their own risk. Wine Concepts®, its associated holding companies, affiliates and subsidiaries cannot be held liable for direct or indirect special, consequential or other damage incurred by:
- users of their website, or
- for any loss caused by an inability to access their website, or
- for any third parties misinterpretation of the website content or
- for any failings in its functionality.The condition of this liability disclaimer applies to all and any third party linked websites, (even should Wine Concepts® management be made aware of a third party website’s failings).
- External Links: The Wine Concepts® website and other communications may contain links and references to third party sites and services suppliers. Wine Concepts® claims neither ownership, nor liability, nor responsibility for the privacy rules or content of any external websites.
- Order Delivery:
- NOTE: Due to Covid related industry closures, deliveries will be done as timeously as possible but we are unable to guarantee how long this will take.
- All deliveries made in South Africa will be via courier to the customers nominated delivery address after receipt of payment. (P.O Boxes are not permitted as a signature of receipt is required).
- During check-out, should the delivery fee not automatically be allocated, or allocated incorrectly, the client remains liable for any delivery charges that are incurred. Should this error occur, a manual invoice will be created and emailed to the client. Payment of delivery charges must be settled in full before delivery will be done.
- All goods must be signed for on delivery. If signed acceptance is not secured at the recorded address when a delivery is attempted, the goods will be retained by the courier, and a notification of the attempted delivery will be left on site. The courier will then return the order to Wine Concepts® and any further delivery attempts will be at the customer’s cost.
- Wine Concepts® will not be liable for any loss due to a delay caused by a customer in the delivery of an order, nor for any loss, damage to or misplacement of delivered products once a delivery has been completed. All damage risks thus shift to the customer once a delivery is completed.
- Returns and Product Quality: Wine Concepts® aims to ensure the good quality of the products and the services they supply.
- If for any reason customers are dissatisfied with the delivery of an order and/or the quality of the products therein, please contact us.
- Any items or products to be returned must be received at our Newlands premises within seven (7) days of delivery to the customer. (Note: The cost of returns will be for the account of the customer).
- If, on inspection, we find that the items were faulty in any respect and these faults were present when delivered, we will refund the price of the items as well as the customer’s cost of returning these items to us.
- We undertake to affect the refund within thirty (30) days of our receipt of the returned items. However should an order not be returned within the seven (7) day period, then it will be deemed to have been accepted and no return will be entertained.
- Country of Domicile: These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. The courts of the Republic of South Africa shall have exclusive jurisdiction to determine any dispute connected with any orders placed with Wine Concepts®.
